DACS is seeking views from visual artists and their estates about the Artist’s Resale Right, to ensure their voice is heard in a current review into its workings by the UK Government. Take part in our survey by midnight, Monday 26 May 2014.
Why is the Artist’s Resale Right under review?
The Artist’s Resale Right entitles artists and their estates to a modest share of a sale or ‘royalty’, each time their work changes hands between an art dealer, auction house or gallery. It was introduced for artists in the UK in 2006, and then extended to include estates in 2012. To qualify, artworks must currently sell for 1,000 euros or more.
The Government has launched a
call for evidence to learn more about:
-
how artists and estates are currently benefitting from the Right,in particular, those receiving royalties from sales taking place at the lower end of the qualifying threshold
-
the cost of administering the Right for auction houses, galleries and dealers
The Government will also use the evidence in a periodic review at an EU level, which is likely to take place in 2015.
Artists and estates – make your voice heard!
DACS proactively campaigned for the introduction of the Right in the UK and currently administers it for artists and estates.
In continuation of this work, we are gathering feedback from artists and estates to ensure the positive impact of the Right on their income, artistic practice and livelihood is recognised by the Government - and that their royalties are protected.
We are also interested to know if significantly more artists would benefit from the Right if the current qualifying threshold were decreased.
If you have ever received royalties through the Artist’s Resale Right, or are an emerging artist likely to benefit from it in the future, please make your voice heard by completing our online survey at the link below:

What happens next?
We'll be presenting the evidence gathered from the survey in our response to review, on behalf of artists and their estates.
The Government will publish its findings later this year in September and we'll report on the outcomes on our website and via social media.
