Artist’s Resale Right EU stakeholders agree next steps

A milestone was reached for the Artist's Resale Right on Monday 17 February 2014 as European stakeholders, including DACS, signed an agreement to improve and harmonise the administration of the Right within the EU.

    Increased cooperation between stakeholders

Overseen by the European Commission in Brussels, DACS joined a host of organisations involved in the administration of the Artist’s Resale Right to formally sign the agreement.

These included international representatives of rights organisations and artists such as CISAC and European Visual Artists (EVA), as well as representatives from the art market including Christies, The Association of Art and Antique Dealers (LAPADA) and the Federation of European Art Galleries Association (FEAGA).

The signed agreement, entitled Key Principles and Recommendations on the management of the Author Resale Right, outlines the key areas where we will cooperate, for example, in the collection and distribution of royalties and in raising awareness of the Right among artists, galleries, auction houses and dealers.

The agreement follows a fruitful year-long dialogue between the stakeholders, led by the European Commission.

Olivier Hinnewinkel, Director General of CISAC said:

“The resale right is a fundamental right for visual artists, whose remuneration primarily comes from the material sale of their works. It allows them to earn an equitable share from the resale of their works on the art market, when these works are resold by galleries or auction houses. The adoption of the ‘Key Principles and Recommendations on the management of the Author Resale Right’ is a significant achievement and an important step in the history of the right in the EU.”

We collect and pay Artist’s Resale Right royalties to artists and estates in the UK, as well as on behalf of the members of our sister societies across the world.

We proactively campaigned for its implementation in the UK, seeing it first introduced for living artists in 2006, and more recently extended in 2012 to include artists’ estates.
